It is, and IF YOU ARE MAKING MONEY off of someone's likeness then you need their consent regardless of whether the location was public or not. They own the rights to their likeness. If you're not making money it's fair use. If you are, and they didn't consent to you monetizing their likeness, that's copyright violation.
