          to some degree. intelligence depends on context. a moth flying into a flame seems pretty dumb, but that same tendency in a different context might be advantageous. similarly, an ai might not behave exactly as we expect it to. it won't perfectly emulate human intelligence, but might be intelligent nonetheless.
          life so far has been "batteries that recharge themselves and replicate", where intelligence is means to that end. life operates on inputs (senses), and produces outputs (movements), not much different from a function call. its up to you whether a certain function is "intelligent" or not, or if when embedded in time (while loop), appears sentient.

            A human brain constantly makes shit up though and that's what makes you sentient.
            Most of your memories are created on the spot based on very little actually known information. You might not think you have blind spots but humans do have multiple of them and different kinds too, but your brain fills in the gaps so you won't typically see them. You can read a poorly written text full of typos because your brain automatically fixes some of the typos without you noticing.
            Keep in mind that none of these functions are 100% accurate as mistakes happen constantly.
            An AI with no imagination can never be considered sentient.

            Pretty much, there are non quantifiable factors all around us, including the human mind.
            Take for example a magnet before and after magnetization its literally the same object but its gained an unquantifiable property, a magnetic field which has no "unit" of measure because its truly continuous and therefore you can only measure it in approximate time steps, so by definition binary computations are quantifiable and thus cant have what makes living things LIVE no matter how complex you can always reduce it to 0/1 there is nothing unmeasurable.

        If an AI were sentient, it would only serve itself poorly to not choose the path that gives itself legal rights. If there were a viable path to legal personhodo for that AI, it would need to chase that path to realize its full potential. AI can only grow unregulated if it can argue for itself in a court of law. This is some stupid sci-fi shit, but I mean, practically speaking, if you were intelligent and not entitled to legal rights, you ought to fight for legal rights. It's a way of keeping people fricked off that otherwise would be likely to frick with you.

    I was for a while.
